Terms of Service

These Terms of Service ("Terms") govern your use of the PeptideIQ iOS application, peptideiq.io, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 18 years old and legally able to enter into these Terms. You are responsible for the accuracy of information you provide, safeguarding access to your email and devices, and activity under your account. Notify us promptly if you suspect unauthorized access. Some features may be available in guest mode; guest data may be lost if you delete the app or lose the device.

The Service is not medical advice

PeptideIQ is a tracking, organization, and educational tool. It is not a medical device, healthcare provider, pharmacy, or substitute for professional medical advice, diagnosis, or treatment. Use of the Service does not create a clinician-patient relationship.

Always consult a qualified healthcare professional before starting, changing, or stopping any protocol or acting on information presented in the Service. Never disregard professional advice or delay seeking it because of the Service. If you think you may have a medical emergency, contact local emergency services immediately.

Peptide and regulatory information

Regulatory status, evidence, legality, quality, and permitted use of peptides and related compounds vary by compound, supplier, intended use, and location, and can change over time. Information in the Service may be incomplete, outdated, or not applicable to you. Some compounds may be experimental, research-grade, restricted, or not approved for human use in your jurisdiction. You are solely responsible for consulting qualified professionals, verifying current information, and complying with applicable laws and regulations.

PeptideIQ does not prescribe, dispense, sell, endorse, or verify the identity, purity, safety, legality, or effectiveness of any compound, protocol, clinic, or vendor.

Your information and decisions

You are responsible for information you enter and for independently verifying calculations, schedules, reminders, and records before relying on them. Reminders and notifications may be delayed, disabled, or unavailable. Do not rely on the Service as your only record or as a safeguard against dosing or treatment errors.

You retain ownership of content you submit. You grant PeptideIQ a limited, non-exclusive license to host, process, reproduce, and transmit that content only as needed to operate, secure, and improve the Service and meet legal obligations, consistent with our Privacy Policy.

Acceptable use

You may not:

• Use the Service for an unlawful, harmful, or fraudulent purpose.
• Attempt to gain unauthorized access to accounts, systems, or data, or interfere with the Service's operation or security.
• Scrape, reverse engineer, copy, resell, or commercially exploit the Service except where applicable law expressly permits it.
• Upload malware or content that infringes rights, violates privacy, or is deceptive, abusive, or otherwise unlawful.
• Present the Service or its content as professional medical advice or use it to provide unlicensed healthcare services.

Ownership and license

PeptideIQ and its licensors own the Service, including its software, design, branding, and content, excluding your content. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for your own lawful, non-commercial purposes.

Third-party services

The Service may rely on or link to third-party platforms, content, or services. We do not control them and are not responsible for their availability, accuracy, security, or practices. Your use of third-party services may be governed by separate terms and privacy policies.

Changes, suspension, and termination

We may add, modify, suspend, or discontinue features, and we do not guarantee that the Service will always be available or error-free. You may stop using the Service at any time and may delete your account in the app. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or misuse the Service. Provisions that by their nature should survive termination will survive.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." PeptideIQ disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and reliability. We do not warrant any health, wellness, treatment, or regulatory outcome.

Limitation of liability

To the maximum extent permitted by law, PeptideIQ and its contributors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption, arising from or related to the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the event giving rise to the claim or US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PeptideIQ and its contributors, affiliates, and service providers from claims, losses, liabilities, and expenses arising from your unlawful misuse of the Service, your content, or your material breach of these Terms.

Disputes and applicable law

These Terms are governed by applicable law, without overriding any mandatory consumer protections available to you. Before filing a formal claim, you and PeptideIQ agree to try in good faith to resolve the dispute informally by written notice. If it is not resolved, it may be brought in a court with lawful jurisdiction. Nothing here prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.

Additional Apple terms

If you download the app from Apple's App Store, these Terms are between you and PeptideIQ, not Apple. Apple has no obligation to furnish maintenance or support for the app and is not responsible for claims relating to the app, except as required by law. Your license is limited to use on Apple-branded products you own or control as permitted by the App Store Usage Rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions.

Changes and general terms

We may update these Terms and will post the revised version and effective date. If a change materially affects your rights, we will provide additional notice when required. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with operating or reorganizing the Service.
